1. The agreement
These terms are between you (the merchant installing Consently on an OpoShop store) and Found, the publisher of Consently. Installing the app means you accept them.
2. What the app does
Consently renders a consent notice on your storefront, gates the third-party trackers you select on the shopper's answer, honours the Global Privacy Control browser signal, maintains a record of consent, and provides an email-verified intake for data-subject requests along with their statutory deadlines.
3. It is not legal advice
Consently is built around what the GDPR, the UK GDPR and the CPRA actually require, and the defaults are chosen to be defensible. It is still a tool, not a lawyer. What your specific business must disclose, which lawful basis applies to your processing, and whether your arrangements are adequate are questions for you — and for qualified counsel where the stakes justify it. We do not warrant that using Consently makes you compliant with any law.
4. What it does not do
- It never writes to your store. It cannot create, change or delete a product, an order or a customer.
- It does not action privacy requests on your behalf. It verifies, files and tracks them; fulfilling them is your decision and your responsibility.
- It cannot stop the very first call of a tracking script pasted directly into your theme's header, because on this platform such scripts run before any app's code exists. The app says so plainly in the Tracking screen and tells you how to move those tags. Every subsequent request from them is blocked and their cookies are cleared on refusal.
5. Your responsibilities
- Keep your own privacy policy accurate, and link it from the notice.
- Classify your trackers honestly. Nothing in the catalogue can be marked "strictly necessary", and you should not try to work around that by other means.
- Respond to privacy requests within the deadline shown. Consently tracks the clock; it cannot answer for you.
- Do not use the app to mislead shoppers about what your store collects.
6. Availability
We aim for the app to be available continuously, but we do not guarantee it. Consently is built to fail invisibly: if the service is unreachable, the notice does not render and no tracker is blocked, so your storefront keeps working normally. That is a deliberate choice — a broken store is worse than a missed notice — and it means an outage can leave a period in which trackers ran unasked.
7. Price
Consently is currently provided at no charge. If that changes, existing merchants will be told well in advance and never charged without an explicit, separate agreement.
8. Liability
To the fullest extent permitted by law, Found is not liable for indirect, incidental or consequential losses, for regulatory penalties, or for lost profits or revenue arising from use of the app. Where liability cannot be excluded, it is limited to the amount you have paid us for Consently in the twelve months before the claim — which, while the app is free, is zero.
9. Ending it
You can uninstall Consently from your OpoShop admin at any time. The notice stops immediately and all blocking stops with it. Your configuration is retained so a reinstall restores it; email us to have it erased instead. We may suspend an account that is being used to abuse the request system or to send mail to people who did not ask for it.
10. Changes
We may update these terms. Material changes will be noted in the app's What's New page and dated at the top of this one.
